Design Patent

  • Protects ornamentality of product (can include mechanical devices, GUI (graphical user interface) elements, packaging, among others)

  • Cost more money to obtain relative to a design patent

  • Can file a design patent application even if a utility patent application is filed

  • Can mark and advertise products as "patent pending" or with the issued patent number

  • Drawings are accepted so long as they meet minimum standards (i.e., drawings in utility applications are scrutinized less rigorously than in design applications)

  • Application pendency at the USPTO can last for several years depending on the art unit and number of rejections issued
